Article 1 – Scope

These Terms and Conditions of Sale (hereinafter the "T&Cs") govern, without restriction or reservation, all sales concluded by the seller identified in Article 2 (hereinafter the "Seller") with any non-professional buyer (hereinafter the "Customer") on the online sales website accessible at https://golden-cbd.eu (hereinafter the "Site").

They apply to the sale of hemp-derived products and their accessories, in particular flowers, resins, pre-rolls and accessories (hereinafter the "Products").

Any order placed on the Site implies the prior, full and unreserved acceptance of these T&Cs by the Customer. The latter acknowledges having read them before validating their order. The applicable T&Cs are those in force on the date of the order. The Seller reserves the right to amend them at any time; the amended T&Cs apply only to orders placed after their publication.

The Customer declares that they are at least 18 years of age and have full legal capacity to contract. The sale of the Products is strictly prohibited to minors.

Article 3 – Products and availability

The Products offered for sale are those appearing on the Site on the day the Customer consults it, subject to available stock. Each Product is accompanied by a description setting out its essential characteristics, in accordance with article L. 111-1 of the French Consumer Code.

The photographs, illustrations and presentation texts are provided for information purposes only and have no contractual value; they cannot engage the Seller's liability in the event of a slight difference in appearance, shade or presentation of the Products delivered.

All the Products comply with a tetrahydrocannabinol (THC) level of less than 0.3% and conform to the French and European regulations applicable to hemp and cannabidiol (CBD).

In the event that a Product is unavailable after the order has been placed, the Seller informs the Customer as soon as possible. The Customer may then choose between replacement with an equivalent Product or cancellation of the order for the Product concerned, with a refund of the sums paid in respect of that Product within a maximum period of fourteen (14) days.

3.1 – Warnings relating to the Products

  • The Products are reserved for adults (18 years and over).
  • The Products are not medicinal products and are not intended for medical or therapeutic use; they cannot prevent, diagnose or cure any disease.
  • It is recommended not to drive a vehicle or operate machinery after consumption, as certain Products may impair alertness.
  • The use of the Products is not recommended for pregnant or breastfeeding women, nor for persons undergoing medical treatment, who are invited to seek the advice of a healthcare professional.
  • The Customer remains solely responsible for compliance with the regulations applicable in their country of residence or delivery, in particular in the case of an order placed outside France.

Article 4 – Prices

The prices of the Products are stated in euros (EUR), inclusive of all taxes, excluding delivery charges. Any delivery charges are specified before the final validation of the order and are invoiced separately.

The Seller reserves the right to modify its prices at any time; the Products are, however, invoiced on the basis of the rates in force at the time the order is recorded.

For deliveries outside France, customs duties, taxes or import charges may be required by the authorities of the country of destination; these sums remain entirely payable by the Customer.

Article 5 – Orders

The Customer places their order online by selecting the desired Products, adding them to their basket, then following the validation process through to payment. Before validation, the Customer has the possibility to check the details of their order and its total price and to correct any errors.

Validation of the order, marked by the double click confirming payment, constitutes conclusion of the contract and acceptance of these T&Cs as well as of the prices and descriptions of the Products. The Seller sends the Customer an order acknowledgement by email summarising the essential elements of the contract.

The Seller reserves the right to refuse or cancel any order for a legitimate reason, in particular in the event of a prior dispute, an abnormal order, suspicion of fraud, non-payment, or where the Customer cannot prove that they are of legal age.

Article 6 – Secure payment

The price is payable in full on the day of the order, by the means of payment offered on the Site, in particular by bank card.

Payments are processed by means of secure transactions provided by the payment service providers integrated into the Shopify platform. The Site does not retain any complete bank details of the Customer. Payment data is exchanged under an encrypted protocol with the banking institution concerned.

The order is only deemed effective after confirmation of payment collection by the payment service provider. In the event of payment refusal, the order is automatically cancelled.

Article 7 – Delivery

The Products are delivered to the address indicated by the Customer when placing the order, in mainland France and in the European Union countries served (hereinafter the "Delivery Zones").

7.1 – Timeframes

Orders are prepared and dispatched as soon as possible. As an indication, the delivery time is generally 24 to 48 hours in mainland France after dispatch. Timeframes to other countries vary according to the zone and the carrier. The timeframes announced are indicative; an overrun cannot, in principle, give rise to compensation, subject to the provisions of articles L. 216-1 et seq. of the French Consumer Code.

7.2 – Carriers and charges

Delivery is carried out by the Seller's partner carriers, in particular UPS. Delivery charges are calculated according to the Delivery Zone and the weight of the order; they are displayed before validation of the order.

Delivery is free for any order with an amount equal to or greater than 69 €, for the Delivery Zones concerned.

7.3 – Receipt

The Customer is invited to check the condition of the parcel and the Products on receipt and to make any reservations with the carrier in the event of damage or shortage. In accordance with article L. 216-4 of the French Consumer Code, the risk of loss or damage to the Products is transferred to the Customer at the time when the Customer, or a third party designated by them, takes physical possession of the Products.

Article 8 – Right of withdrawal

In accordance with articles L. 221-18 et seq. of the French Consumer Code, the consumer Customer has a period of fourteen (14) days from receipt of the Products to exercise their right of withdrawal, without having to give any reason or bear any penalty.

To exercise this right, the Customer notifies the Seller of their decision by an unambiguous statement, for example to the email or postal address indicated in Article 2, or by means of the standard withdrawal form. The deadline is deemed to have been met if the notification is sent before the expiry of the fourteen (14) days.

8.1 – Exceptions to the right of withdrawal

In accordance with article L. 221-28 of the French Consumer Code, the right of withdrawal cannot, in particular, be exercised for:

  • the supply of goods unsealed after delivery and which cannot be returned for reasons of hygiene or health protection;
  • the supply of goods likely to deteriorate or expire rapidly;
  • the supply of goods made to the Customer's specifications or clearly personalised;
  • the supply of goods which, after having been delivered, have been inseparably mixed with other items.

Consequently, unsealed or opened Products, or those that have lost their original sealed packaging (in particular opened flowers, resins and pre-rolls), cannot be subject to withdrawal for reasons of hygiene and health protection.

Article 9 – Returns and refunds

In the event of a valid exercise of the right of withdrawal, the Customer returns the Products, in their original sealed packaging and in perfect condition, within fourteen (14) days following the communication of their decision. The direct costs of return remain payable by the Customer, unless otherwise provided by the Seller.

The Seller refunds all the sums paid, including standard delivery charges, no later than fourteen (14) days after being informed of the decision to withdraw. The Seller may, however, defer the refund until the Products have been recovered or until the Customer has provided proof of dispatch. The refund is made using the same means of payment as that used for the order, unless the Customer expressly agrees otherwise.

The Customer may be held liable in the event of depreciation of the Products resulting from handling beyond what is necessary to establish their nature, characteristics and proper functioning.

Article 10 – Legal warranties

Independently of any commercial warranty, the Seller remains bound by the legal warranties of conformity and against hidden defects.

Legal warranty of conformity (articles L. 217-3 et seq. of the French Consumer Code): the Customer has a period of two (2) years from delivery of the Product to act; they may choose between repair or replacement of the Product, subject to the cost conditions provided for by law.

Warranty against hidden defects (articles 1641 et seq. of the French Civil Code): the Customer may choose between rescission of the sale or a reduction in price, in accordance with article 1644 of the French Civil Code, within a period of two (2) years from the discovery of the defect.

To enforce these warranties, the Customer may contact customer service at the contact details set out in Article 13.

Article 11 – Liability

The Seller is bound by an obligation of means in respect of the operation of the Site and the supply of the Products. Its liability cannot be engaged in the event of non-performance attributable to the Customer, to the unforeseeable and insurmountable act of a third party, or to a case of force majeure.

The Seller cannot be held liable for the use the Customer makes of the Products, nor for the Customer's failure to comply with the regulations applicable in their country of residence or delivery. The Customer uses the Products under their sole responsibility.

No provision of these T&Cs has the effect of excluding or limiting the Seller's liability in cases where such an exclusion would be unlawful under consumer law.

Article 12 – Intellectual property

All the elements of the Site (trademarks, logos, text, photographs, illustrations, graphics, structure and tree structure) are protected by intellectual property law and remain the exclusive property of the Seller or of its partners. Any reproduction, representation, modification or use, in whole or in part, without prior written authorisation, is prohibited and liable to constitute an infringement.

Article 13 – Personal data and customer service

The personal data collected in connection with orders is processed in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act ("Informatique et Libertés"). The procedures for collecting and processing data and for exercising the Customer's rights are detailed in the Privacy Policy: /pages/politique-de-confidentialite.

Article 14 – Applicable law, mediation and dispute resolution

These T&Cs are subject to French law. In the event of a dispute, the consumer Customer is invited to contact customer service beforehand (Article 13) in order to seek an amicable solution.

In accordance with articles L. 611-1 et seq. of the French Consumer Code, the consumer Customer has the right to have recourse, free of charge, to a consumer mediator. The Seller will appoint an approved consumer mediator; their name and contact details will be published on this page as soon as they are available. In the meantime, the Customer may send their request to customer service and use the European platform below.

The Customer may in any event use the European Online Dispute Resolution (ODR) platform made available by the European Commission, accessible without any membership requirement: https://ec.europa.eu/consumers/odr.

Failing an amicable settlement, the dispute will be brought before the competent courts under the conditions provided for by ordinary law. The consumer Customer retains the benefit of the protective rules of jurisdiction provided for by the French Consumer Code.
