Is CBD Legal in the Czech Republic?
Short answer: yes, CBD is legal in the Czech Republic, which today has one of the most open frameworks in Europe. Technical hemp (technické konopí) is defined there by a THC threshold of up to 1% in dry matter — the highest in the European Union. The country deeply reformed its law in 2024-2025: Act No. 321/2024 Sb., in force since 1 January 2025, created the category of “psychomodulační látky” (psychomodulatory substances), which notably regulates low-THC cannabis and kratom, with sales reserved for adults in specialised shops since 1 July 2025. CBD foods remain subject to the European “Novel Food” regulation. Here is the full picture, section by section.
The legal framework for CBD in the Czech Republic
CBD (cannabidiol) is a non-psychotropic cannabinoid extracted from hemp (Cannabis sativa L.). In Czechia, the reference text is the Act on Addictive Substances (No. 167/1998 Sb.), amended several times. Since the reform that took effect in early 2022, technical hemp (technické konopí) has been defined by a THC content not exceeding 1% of dry matter — up from 0.3% previously, and compared with 0.2 to 0.3% in most other EU countries. Its cultivation, processing and sale for technical, industrial or horticultural purposes are permitted. Pure CBD, with no detectable THC, is classified neither as a narcotic nor as a psychomodulatory substance. To understand the difference between CBD and THC, see our guide CBD or THC: what are the differences.
The 2024-2025 reform: the “psychomodulační látky”
The big Czech novelty is Act No. 321/2024 Sb., published in November 2024 and in force since 1 January 2025. It creates a category unprecedented in Europe: psychomodulatory substances (psychomodulační látky), which include notably kratom and cannabis containing up to 1% THC, as well as its extracts and tinctures. Rather than prohibiting, Czechia chose to regulate: since 1 July 2025, the sale of these products is authorised but strictly framed — specialised shops closed to under-18s, a ban on displaying them next to products intended for children, and an obligation for online sellers to have a physical point of sale. Above 1% THC, the product remains an addictive substance whose handling without a licence constitutes a criminal offence.
CBD and “Novel Food”: the case of edible products
At European level, foods containing extracted cannabidiol fall under Regulation (EU) 2015/2283 on novel foods (“Novel Food”), available on eur-lex.europa.eu. In practice, a CBD food or food supplement can only be placed on the market after an authorisation issued by the European Commission, based on a safety assessment. Several applications are under review, but no general authorisation has yet been granted for CBD as a food ingredient. The Czech Republic applies this reading to CBD foods and supplements, while CBD cosmetics remain authorised under the European cosmetics regulation. The local offer therefore focuses on flowers and resins, cosmetics and wellness oils.
What about CBD flowers?
CBD flowers (CBD květy) are widely available in the Czech Republic and benefit from the 1% THC threshold applicable to technical hemp — a Czech singularity in Europe. Since the 2025 reform, hemp flowers and liquids for inhalation may fall under the psychomodulatory substances regime: sales reserved for adults, specialised shops and strict display rules. For consumers, the right reflexes remain the same everywhere in Europe: favour products tested by an independent laboratory, accompanied by their certificates of analysis, and check the THC content — a product compliant with the European 0.3% threshold is also, a fortiori, compliant with the Czech 1% threshold. Check the local rules in force at the time of purchase, as the reform's implementing texts are still being refined.
The European framework: the “Kanavape” ruling and free movement
The legal cornerstone of the European CBD market is the “Kanavape” ruling (case C-663/18), handed down by the Court of Justice of the European Union on 19 November 2020 and available on curia.europa.eu. The Court held that CBD extracted from the hemp plant in its entirety is not a narcotic within the meaning of international conventions, and that a Member State cannot prohibit the marketing of CBD legally produced in another Member State unless it demonstrates a real risk to public health. This principle of free movement of goods directly benefits Czech consumers, who can order compliant CBD products from shops established elsewhere in the European Union. In France, by comparison, it is the decree of 30 December 2021 that sets the THC threshold at 0.3% (text available on legifrance.gouv.fr).
Buying CBD with peace of mind
All Golden CBD products are laboratory tested, contain less than 0.3% THC and therefore comply with both the European framework and the more permissive Czech threshold; do check the local rules in force, however, as the Czech reform is recent. Before any purchase, a few simple reflexes: check the stated THC content, review the certificates of analysis, choose a seller who is transparent about the origin of the hemp, and avoid any product making therapeutic promises — CBD is about well-being, not medicine. FAQ — CBD and legality in the Czech Republic
Is CBD legal in the Czech Republic?
Yes. CBD from technical hemp is authorised, and Czechia applies the highest THC threshold in the EU (1% in dry matter). CBD foods remain subject to the European “Novel Food” authorisation.
What is the permitted THC limit in Czechia?
Technical hemp (technické konopí) is defined by a THC content not exceeding 1% of dry matter, compared with 0.2 to 0.3% in most European countries. Above 1%, the product is treated as an addictive substance.
What are the “psychomodulační látky”?
It is a category created by Act No. 321/2024 Sb., in force since 1 January 2025. It notably includes kratom and cannabis up to 1% THC (including extracts and tinctures), whose sale has been authorised since 1 July 2025 in specialised shops reserved for adults. Pure CBD with no detectable THC is not part of it.
Does CBD get you high?
No. CBD is not psychotropic, unlike THC. It does not produce a “high” effect.
Can CBD be delivered to the Czech Republic?
Yes. Thanks to the principle of free movement confirmed by the CJEU “Kanavape” ruling (C-663/18), compliant CBD products (THC < 0.3%, laboratory tested) can be shipped to Czechia from other European Union countries. Check the local rules in force at the time of ordering.
Can Czech regulations change?
Yes. The psychomodulatory substances reform is recent and its implementing texts are still being refined; the European “Novel Food” framework is also evolving. Always check the local rules in force before buying.
